Waterman, Russell and Keane Receive Unanimous Opinion from Kentucky Supreme Court

Louis I. Waterman, Allison S. Russell, and Megan P. Keane of Goldberg Simpson successfully argued before the Supreme Court of Kentucky and received a unanimous opinion from the Court upholding a ruling from the Jefferson Circuit Court awarding their client attorneys’ fees in a custody action.  The Kentucky Supreme Court’s opinion overturned forty years’ worth of case law and agreed with the arguments of the Goldberg Simpson attorneys that a financial disparity is not required when a trial court determines that an award of attorneys’ fees is proper pursuant to KRS 403.220.  Trial courts only need to consider the financial resources of the parties prior to determining the reasonableness of an award of attorneys’ fees.
